Octomark

Octomark Terms of Use

Effective date: 24 October 2026 · Version 1.0

The short version

1. About these terms

These terms are an agreement between you and the seller of Octomark named in section 2. They apply to the Octomark app for iPhone, iPad and Android devices and to the website octomark.app. By installing or using Octomark you accept them. If you do not agree, please do not use Octomark.

If you are under 18, ask a parent or guardian to read these terms with you. By letting you use Octomark, they agree to these terms on your behalf; no separate form or sign-up is needed. Subscriptions are bought by an adult, or with an adult's approval through the store's family features.

In places whose app store laws require a parent's or guardian's consent to be recorded before a minor uses an app (for example some US states), these terms bind a minor only once that consent has been given through the App Store or Google Play. We rely in good faith on the age and consent information the store gives us.

2. Who we are

Octomark is published and sold by [FULL LEGAL NAME], a sole trader registered in Portugal, tax number [NIF]. Postal address: [Apartado NNNN, NNNN-NNN LOCALITY], Portugal. Email: support@octomark.app. Telephone: [PHONE]. Questions, complaints and claims about Octomark go to these contacts. In these terms "we" and "us" mean this seller.

3. What Octomark is

Octomark is a reference guide and practice tool for students aged 11 to 16 who study in schools that use criterion-based assessment, and for their parents. It contains articles that explain what each assessment criterion asks for, quizzes with recommendations on what to practise next, and written tasks with a checklist and a model answer for self-checking.

Octomark is a study aid, not a school service:

4. The free part and Octomark Plus

The reference guide (all articles) and the first question of every quiz are free, so you can try each subject. The rest of the quizzes, the written tasks and progress by criterion are part of Octomark Plus, an auto-renewing subscription described in section 8.

5. Independent from the IB

This product has been developed independently from and is not endorsed by the International Baccalaureate Organization. International Baccalaureate, Baccalauréat International, Bachillerato Internacional and IB are registered trademarks owned by the International Baccalaureate Organization.

Octomark does not reproduce the IB's publications. The names of programmes, subjects and criteria appear in Octomark only so that you can find the matching part of your school's own assessment tables.

6. Your licence to use Octomark

We grant you a personal, non-exclusive, non-transferable licence to install and use Octomark, for your own or your family's study, on devices that you own or control and that are linked to the store account used for the download or purchase. Family Sharing on Apple devices and family purchase approval on Google Play are allowed as the stores permit them.

You may not:

All content, text, illustrations, software and the Octomark name and logo belong to us or to our licensors. If you send us suggestions, we may use them without owing you anything.

7. Your data

Octomark collects no personal data. There is no account, no analytics, no advertising and no tracking. Your results and progress are stored only on your device; if you delete the app, they are deleted too, and we cannot restore them. The only personal data we handle is email that you choose to send to support@octomark.app, plus the sales reports the stores send us for accounting, which we cannot link to you. Details are in the Privacy Policy at octomark.app/privacy, which forms part of these terms.

8. Octomark Plus subscription

8.1 How it is sold. Octomark Plus is sold only through Apple's App Store (for iPhone and iPad) and Google Play (for Android), using your account with that store. The store shows the price in your currency, taxes included, takes the payment and issues the receipt. Prices may differ between countries and stores.

8.2 Plans. A monthly plan and a yearly plan, both with the same content. Prices are shown in the app and in the store before you buy.

8.3 Free trial. New subscribers get the first 7 days free, once per store account. Apple counts the monthly and yearly plans together, so you get one trial for Octomark Plus whichever plan you choose. If you cancel before the trial ends (on iPhone and iPad, at least 24 hours before it ends), you pay nothing. If you do not cancel, the paid period starts when the trial ends, at the price shown when you subscribed.

8.4 Automatic renewal. The subscription renews automatically at the end of each period, at the price then shown in the store, until you cancel it. On Apple devices, cancel at least 24 hours before the end of the current period to avoid the next charge; Apple charges renewals within the 24 hours before the period ends. On Google Play, cancelling stops the next charge; you keep access until the end of the period you have paid for.

8.5 How to cancel. iPhone and iPad: Settings › your name › Subscriptions. Android: Google Play › Payments and subscriptions › Subscriptions, or the Manage subscription button in the app. Deleting the app does not cancel the subscription.

8.6 Refunds and the right of withdrawal. Refunds are paid through the store you bought from, under its rules and under the consumer law of your country, including any right to withdraw from a distance purchase. Ask the store first: on Apple, at reportaproblem.apple.com; on Google Play, through Order history or Google's refund form. The store holds your payment, so this is the fastest way. If you are entitled to a refund under your law (for example after ending the contract under section 9 or section 11) and the store does not provide it, email support@octomark.app and we will make sure you are refunded within 14 days.

8.7 Price changes. If we change the price of Octomark Plus, the store tells current subscribers in advance under its rules and, where required, asks for your agreement before the new price applies. If you do not agree, you can cancel before the next renewal.

8.8 Family Sharing. On Apple devices Octomark Plus supports Family Sharing: up to five other members of your Apple Family can use it. On Google Play, a subscription belongs to the Google account that bought it and works on that account's devices.

8.9 Devices. A subscription works on all devices signed in to the same store account. It does not transfer between the App Store and Google Play.

8.10 Reminders. The store you bought from sends its own notices about your trial and renewals. Where the law where you live requires a reminder before a free trial becomes a paid subscription (for example in Quebec) and the store does not send one, the app shows you a reminder on your device a few days before the trial ends.

9. Changes to the app and its content

We update Octomark for these reasons: to fix errors; to add or improve articles, quizzes and tasks; to follow changes in the assessment tables that schools use; to keep the app secure and working on new devices and system versions; and to meet legal or store requirements. Content may be added, revised or removed for these reasons, at no extra cost to you. During your subscription we supply the updates needed to keep Octomark Plus working as described.

If a change would make Octomark Plus noticeably less useful to subscribers, we tell you clearly in the app before it takes effect, and you can cancel the subscription. If you live in the EU, EEA or United Kingdom and such a change negatively affects your access to or use of the content in more than a minor way, you also have the right to end the contract free of charge within 30 days of being told or of the change, whichever is later, and to ask the store for a proportionate refund, as your law provides.

Some features need a current version of the app or of the operating system; we may stop supporting very old system versions.

10. Availability

Octomark works offline. It needs an internet connection only to check or buy a subscription. If the store is unreachable, the free part keeps working and a subscription already on the device keeps working until it is next checked. We do our best to keep Octomark available but cannot promise it will be free of interruptions or errors.

Octomark runs on iPhone and iPad with iOS [NN] or later and on Android phones and tablets with Android [NN] or later; the current requirements and the languages available are shown in the store listing.

11. Your statutory rights

If you are a consumer in the EU, EEA or United Kingdom, you have legal rights if digital content does not work as described or as it reasonably should. Nothing in these terms limits those rights or any other right that the law of your country of residence gives you and that cannot be excluded by contract.

12. Our responsibility to you

We are responsible for losses you suffer as a direct and foreseeable result of our breach of these terms or of the law. We are not responsible for losses that were not foreseeable, for losses caused by your own breach of these terms, or for school results, grades or decisions, which depend on your work and your school.

To the extent the law allows, our total liability to you for all claims in any 12-month period is limited to the amount you paid for Octomark Plus in those 12 months. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or intentional misconduct, for gross negligence, or for anything else that the law does not allow us to exclude or limit.

13. Ending this agreement

You can stop using Octomark at any time by deleting the app and cancelling any subscription in the store. We may end your licence if you seriously or repeatedly break these terms; your statutory rights are not affected. Sections 5, 6, 11, 12 and 18 continue to apply after the agreement ends.

14. If Octomark moves to a company

We may transfer Octomark, including this agreement and the subscriptions under it, to a company owned and controlled by the same person who publishes it today. Your rights and obligations under these terms stay the same, and nothing about your subscription or your data changes because of the transfer; Octomark collects no personal data, so there is no personal data to hand over beyond support emails still kept under the Privacy Policy. We will update the seller's details in these terms, in the Privacy Policy and in the stores, and announce the change in the app and on octomark.app. You may not transfer your rights under these terms to anyone else.

15. Terms required by Apple and Google

15.1 Apple. If you downloaded Octomark from the App Store, the following also applies:

  1. Acknowledgement. These terms are concluded between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for Octomark and its content. These terms do not grant you rights that conflict with the Apple Media Services Terms and Conditions.
  2. Scope of licence. Your licence is limited to a non-transferable licence to use Octomark on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Octomark may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for providing any maintenance and support for Octomark, as stated in these terms or required by law. Apple has no obligation to provide any maintenance or support for Octomark.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Octomark fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Octomark to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Octomark, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Octomark or your possession or use of it, including product liability claims, any claim that Octomark fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation. These terms do not limit our liability to you beyond what the law permits.
  6. Intellectual property. If a third party claims that Octomark or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of the claim.
  7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
  8. Developer name and address. Our name, address and contact details for questions, complaints and claims are in section 2.
  9. Third-party terms. You must comply with any applicable third-party terms when using Octomark, for example your mobile data agreement.
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.

15.2 Google. If you downloaded Octomark from Google Play, the Google Play Terms of Service and Google Play's refund and subscription rules also apply to the download and to purchases. Google is not a party to these terms and is not responsible for Octomark or its content.

16. Changes to these terms

We may change these terms to reflect changes in Octomark, in the law or in store rules. The current version is always at octomark.app/terms and in the app, with its effective date. If a change is significant for you, we tell you in the app at least 30 days before it takes effect; if you do not agree, you can stop using Octomark and cancel your subscription before the change applies. Continuing to use Octomark after that date means you accept the new terms.

17. General

If a part of these terms turns out to be invalid, the rest still applies. If we do not enforce a term immediately, we can still enforce it later. These terms, with the Privacy Policy and the store's purchase terms, are the whole agreement between you and us about Octomark.

18. Law and disputes

These terms are governed by the law of Portugal. If you are a consumer living in another country, you also keep the protection of the mandatory consumer laws of that country, and you may bring a claim in the courts of that country.

If you have a complaint, please email support@octomark.app first; most problems are solved within a few days. Consumers may also use Portugal's electronic complaints book (Livro de Reclamações Eletrónico, https://www.livroreclamacoes.pt/); we answer complaints filed there within 15 working days. You may also turn to the consumer arbitration centres listed by the Portuguese Directorate-General for Consumers (https://www.consumidor.gov.pt/), including the national centre CNIACC (https://www.cniacc.pt/). Under Portuguese law (Law 24/96, Article 14), you can choose to bring a dispute of reduced value, meaning up to the limit for first-instance courts (currently EUR 5,000), before such a centre, and we must then take part. Details are on the Seller information page at octomark.app/seller.

19. Language

These terms are written in English and provided in Spanish, French, Chinese (Simplified), German and Russian. If you live in Quebec, the French version applies to you. Elsewhere, if a translation and the English text differ, the English text explains what we meant.
